Terms & Conditions of Trade
These Terms & Conditions ("Terms") govern all contracts, sales, and trade agreements between Prime Agro Group ("we") and our buyers ("you", "your"). By placing an order, you agree to these Terms. All purchase orders are subject to written acceptance by us. We reserve the right to accept or reject any order at our discretion. Shipments are made according to agreed Incoterms (FOB, CIF, etc.). Risk of loss passes to the buyer upon delivery to the carrier, unless otherwise agreed. Our coffee exports comply with relevant Kenyan and international quality standards. Buyers shall inspect goods upon arrival and notify us within 7 days of any claims regarding non-conformance. Orders may not be cancelled after confirmation except by written agreement. Refunds, if applicable, are subject to our Refund Policy. Our liability is limited to the value of the goods supplied. We are not liable for indirect or consequential losses, including lost profits. Both parties shall comply with all applicable trade, export, and import regulations in Kenya and the buyerβs country of destination. We are not responsible for delays or non-performance due to causes beyond our reasonable control, including natural disasters, strikes, or government restrictions. These Terms are governed by the laws of Kenya. Any disputes shall first be resolved amicably, failing which they may be referred to arbitration in Nairobi under Kenyan law. Prime Agro Group1.
